Stay Away Order
A Stay Away Order is an Order issued by a Judge in a domestic violence, domestic battery, or stalking case. The Order is effective unless cancelled or modified during the period that the court has jurisdiction over the case. The court has jurisdiction over a domestic violence or spousal abuse case during the pendency of the case and any period of Probation. Judges in domestic assault and stalking cases always impose a period of probation unless the person accused of domestic violence is found not guilty or the district attorney dismisses the case. Stay Away Orders are different from Emergency Protective Orders, Domestic Violence Restraining Orders or No Harassment Orders.
